Terms and Conditions

Welcome to Elevate Marquee and Events (“we”, “our”, “us”). These Terms & Conditions (“Terms”) govern all bookings, hire agreements, and use of our website. By confirming a booking or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Definitions

  • Hirer/Client: The person or organisation hiring the equipment.

  • Equipment: Any marquee, furniture, accessories, or other items provided by Elevate Marquee and Events.

  • Hire Period: The period from delivery and setup to collection of the equipment.

  • Site: The location where the equipment will be installed.

​

2. Bookings & Payments

2.1 All bookings must be confirmed in writing.
2.2 No booking is confirmed until the bond is received.
2.3 The service cost in full balance must be paid on the day and time of installation. 
2.4 Bookings made within 2 days of the event date require full payment at the time of booking.
2.5 We reserve the right to cancel unconfirmed bookings without notice.

3. Cancellations & Refunds

3.1 All cancellations must be made in writing.
3.2 Deposits and bonds are non-refundable upon cancellation by the client. 
3.3 If cancellation occurs, the bond is automatically deemed as non-refundable. 

3.4 If we cancel due to safety concerns, equipment failure, or force majeure, we will offer a full refund or credit note (at our discretion).

4. Site Access & Preparation

4.1 The hirer must ensure:

  • The site is level, clear of obstacles, and suitable for installation.

  • All underground services (water, gas, electrical) are clearly marked.

  • Adequate access for delivery vehicles and installation crews is provided.

4.2 If access or site conditions prevent installation, we reserve the right to cancel the booking with no refund.

 

5. Delivery, Setup & Collection

5.1 Delivery and collection times will be agreed prior to the event.
5.2 The hirer must be present (or have a nominated representative) at delivery and collection.
5.3 Additional fees may apply for:

  • Out-of-hours delivery or collection

  • Difficult access or excessive distance from parking to site

  • Waiting times exceeding 30 minutes caused by the hirer

5.4 Equipment remains the property of Elevate Marquee and Events at all times.

6. Equipment Use & Care

6.1 Equipment must only be used for its intended purpose.
6.2 The hirer must not sub-hire, alter, move, or repair the equipment without our consent.
6.3 Decorations may be attached using non-damaging methods only — no nails, screws, adhesives, or tapes unless approved in writing.
6.4 The hirer is responsible for protecting equipment from damage, theft, vandalism, or adverse weather.
6.5 Smoking, open flames, BBQs, and heating appliances are prohibited inside marquees unless supplied by us.

7. Damage, Loss & Cleaning

7.1 The hirer is liable for all damage, loss, or theft of equipment during the hire period.
7.2 Any damage will be charged at the full repair or replacement cost.
7.3 Excessive cleaning (e.g., mud, food, drink spills) will incur additional cleaning fees.

8. Safety & Weather

8.1 We may refuse installation or dismantle equipment if weather conditions make it unsafe.
8.2 We are not responsible for loss or inconvenience caused by weather-related cancellations or interruptions.
8.3 The hirer must comply with all safety instructions provided.

9. Insurance

9.1 The hirer is responsible for obtaining any event insurance necessary to cover potential losses, cancellations, or liabilities.
9.2 We hold public liability insurance but this does not cover the hirer’s negligence or misuse of equipment.

10. Indemnity & Liability

10.1 The hirer indemnifies Elevate Marquee and Events against all claims, damages, costs, and expenses arising from the use of the equipment, except where caused by our negligence.
10.2 We are not liable for any indirect or consequential loss (including loss of profit, loss of enjoyment, or event cancellation) arising from the hire.

11. Photography & Marketing

11.1 We may take photographs of our equipment at your event for promotional purposes unless you request otherwise in writing before the event.

12. Force Majeure

12.1 We are not liable for failure to perform due to circumstances beyond our control including extreme weather, natural disasters, pandemics, strikes, or government restrictions.

13. Dispute Resolution

13.1 If a dispute arises, both parties agree to attempt to resolve it through good-faith negotiation before seeking legal action.

14. Governing Law

14.1 These Terms are governed by the laws of Victoria, Australia.
14.2 Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

15. Event Changes & Variations

15.1 Any changes to your booking, including marquee size, accessories, or hire dates, must be requested in writing.
15.2 Changes are subject to availability. If a change incurs additional costs, these must be paid before the new hire date.
15.3 We reserve the right to decline changes that compromise safety, scheduling, or logistics.

16. Permits & Legal Compliance

16.1 The hirer is responsible for obtaining any required permits, approvals, or consents from local councils or authorities for temporary structures.
16.2 Failure to obtain necessary permits may result in cancellation or removal of equipment, and no refund will be provided.

17. Electrical & Technical Equipment

17.1 Any electrical or technical equipment provided (e.g., lighting, heaters, fans, AV equipment) must be used in accordance with the instructions provided.
17.2 The hirer is responsible for any damage caused by misuse or tampering with electrical or technical equipment.
17.3 We reserve the right to disconnect or remove equipment if safety is compromised.

18. Alcohol & Catering

18.1 The hirer is responsible for complying with all laws and regulations regarding the supply and consumption of alcohol on site.
18.2 Any catering setup must be approved prior to the event if it could affect the integrity of marquees, flooring, or equipment.
18.3 We accept no liability for accidents, incidents, or legal issues arising from alcohol or catering.

19. Pets & Wildlife

19.1 Pets or animals are not permitted inside marquees unless specifically approved in writing.
19.2 The hirer is responsible for any damage caused by animals, including soiling, scratching, or chewing of equipment.

20. COVID-19 & Health Regulations

20.1 The hirer is responsible for ensuring the event complies with any government-mandated health regulations, including social distancing, sanitation, or attendance limits.
20.2 We reserve the right to postpone, reschedule, or cancel events due to health restrictions, extreme illness, or government directives, with options for credit or refund at our discretion.

21. Confidentiality & Privacy

21.1 Any personal information collected during the booking process will be stored securely and used only for the purposes of fulfilling the hire agreement.
21.2 We will not share personal information with third parties.

22. Severability

22.1 If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

23. Entire Agreement

23.1 These Terms constitute the full agreement between the parties regarding the hire of equipment and supersede any prior discussions, communications, or agreements.

24. Installation Integrity and Equipment Tampering

 

24.1 Once the marquee and any associated safety equipment have been installed by Elevate Marquee and Events (“the Company”), the Hirer acknowledges and agrees that the structure and all equipment must remain in the precise position and configuration as installed. This requirement is imposed strictly for reasons of safety and structural integrity.

 

The Hirer must not, and must not permit any third party to, move, relocate, alter, adjust, interfere with, or otherwise tamper with the marquee or any associated equipment supplied and installed by the Company, including but not limited to walls, roofs, poles, anchors, flooring, furnishings, or fixtures.

 

In the event that the marquee or any associated equipment is found to have been moved, altered, or tampered with in any manner without the Company’s prior written consent, the Hirer shall be deemed fully liable for any resulting damage, loss, or deterioration of the equipment, whether direct or consequential.

 

The Hirer agrees to indemnify and compensate the Company for:

1. The full cost of repair and/or replacement of any damaged components; or

2. Where repair is not reasonably practicable, the full retail replacement value of the marquee and/or affected equipment, as determined by the Company.

 

The Company reserves the right to recover such costs from the Hirer as a debt due and payable immediately upon demand.
